JOOOKOOO RELEASE & WAIVER
As the parent/guardian, I hereby grant permission for the child to independently participate in JOOOKOOO’s programs. I hereby release JOOOKOOO, and its employees from all claims resulting from illness, injuries, or other incidents that may be sustained by the child during attendance at JOOOKOOO’s programs. In the event of illness or injury, I hereby authorize the staff members of JOOOKOOO to obtain medical assistance or any other appropriate treatment for the child. In consideration of JOOOKOOO’s services, property, and/or equipment, I agree to allow my child to participate in JOOOKOOO’s programs, which includes but is not limited to outdoor sports, activities and learning.
CODE OF CONDUCT
The safety of each individual in the program is of the utmost importance to JOOOKOOO. Each participant must recognize a personal responsibility to learn and follow at all times the safety and other rules established by JOOOKOOO staff. I hereby agree that any behaviour of the participant that places them or others at risk may result in the participant’s immediate dismissal from the program. Further, if dismissed from the program, I agree to cover any expense(s) arising from such dismissal. I hereby acknowledge and agree that no refund will be granted for dismissal or removal of the participant before the end of a program session. In order to ensure the safety and well‐being of all individuals participating in the program, JOOOKOOO reserves the right to alter the program at any time without notice or compensation to the participant.
ASSUMPTION OF RISK AND INDEMNIFYING RELEASE
While JOOOKOOO staff and instructors will make every reasonable effort to minimize exposure to known risks associated with each participant’s involvement with JOOOKOOO’s program, I hereby acknowledge that the participant may participate in various physical activities that may involve risk of injury. In consideration for the participant’s opportunity to participate in the programs, I hereby release and forever discharge JOOOKOOO, its respective officers, directors, employees, volunteers and agents, and their respective successors and assigns, from any and all liability for damages sustained in consequence of loss, injury or damage to the participant, and from all other actions, causes of action, claims, demands or damages of any kind with respect to death, injury, loss or damages to any person or property arising out of or connected with preparation for, or participation in, the programs.
MEDICAL EMERGENCIES
In the event of an accident, injury or illness involving the participant, and contact by JOOOKOOO with a designated contact cannot be made, I hereby authorize and grant permission to JOOOKOOO staff to secure proper medical assistance as deemed necessary by the attending medical professional(s). I agree not to hold JOOOKOOO responsible for any costs or injury arising out of an emergency.
COMMITMENT TO PRIVACY
JOOOKOOO is committed to protecting personal information by following responsible information handling practices. We collect and use information you volunteer when you access or register for a JOOOKOOO program, in order to better meet your service needs, to ensure a safe environment, for statistical and assessment purposes, to inform you about current and future programs.
PHOTO AND VIDEO CONSENT
For marketing, advertising, promotional and/or communication purposes, JOOOKOOO may, from time to time, take photographs and/or video recordings of JOOOKOOO activities or events that include real people, which photographs and video recordings will be used for JOOOKOOO promotional or advertising purposes, and by any other person, including third parties, authorized by JOOOKOOO to use such photos or video recordings. I hereby agree to allow photographs and/or video recordings to be taken of the participant or the participant’s family, whether posed or candid, while I am at a JOOOKOOO event may be reproduced, published, displayed, broadcast, transmitted, licensed, sublicensed or otherwise used by the JOOOKOOO or any authorized third party, including without limitation on JOOOKOOO’s social media platforms, printed materials, or in any other materials or medium.
I understand that the work is being created under the direction and control of JOOOKOOO. I hereby irrevocably assign to the JOOOKOOO any and all rights, including copyright, financial or other rights, and I hereby irrevocably waive in favour of JOOOKOOO and any authorized third party any and all moral rights or rights of similar nature that I may have in the work. I agree that the JOOOKOOO has the sole ownership and rights including copyright interests, and I acknowledge that I have no interest or ownership in its copyright.
I agree that I will not bring or consent to others bringing a claim or action against JOOOKOOO on the grounds that anything contained in the work or in the manner in which the work is used, is defamatory, reflects adversely on me, or violates any other right whatsoever, including, rights of privacy and publicity. I hereby release and forever discharge JOOOKOOO, any authorized third party and their respective officers, directors, employees, agents, partners and affiliates, and their respective heirs, executors, personal legal representatives, successors and assigns, as applicable, from all actions, claims, causes of action, suits, demands, liabilities and damages whatsoever, in law or equity, which I may have against any of them in connection with the work.
LOST AND FOUND DISCLAIMER
JOOOKOOO’s staff will do their best to ensure participants return home with all their personal belongings however JOOOKOOO cannot be held responsible for any lost or damaged items. We encourage participants to ensure that valuables, including technology and toys, are left at home.
ACKNOWLEDGEMENT
I confirm that I am over the age of majority in my province or territory of residence and am competent to execute this agreement; or, to the extent that I am under the age of majority in my province or territory of residence, have had my parent or guardian review this agreement and have obtained their consent for the participate in JOOOKOOO’s programs.
I forever release and discharge JOOOKOOO, all their employees, all their members and managers, and the staff of this program for any liability that may occur during my child’s visit. For themselves and their family, the undersigned has read and voluntarily signed the release and waiver of liability and indemnity agreement, and further agrees that no oral representations, statements, or inducements apart from the forgoing written agreement have been made.
